Injured Mother and Children Recover Settlement After Crosswalk Accident

A client of Ciccarelli Law Offices had the misfortune of being involved in a nightmare accident in West Chester. While legally crossing the street at a pedestrian crosswalk in accordance with the traffic control device, our client was struck from behind by a driver who could not see over the steering wheel of the large vehicle. Predictably, this resulted in serious injuries to her back, hip, legs and skin. What’s worse is that she walked across the street holding her eight week old child while pushing her two year old in the stroller. The children were struck as well, resulting in a terrifying scene where both children were thrown to the ground. Thankfully, the children were unharmed, though shaken.

In cases involving auto-accidents, Pennsylvania can be a complicated state to sue a driver in. Under the Motor Vehicle Financial Responsibility Act, every driver is required to have a minimum of $5,000 Personal Injury Protection (PIP) policy. Sometimes, drivers have more than the required $5,000 coverage plan. When a plaintiff is involved in an auto-accident case, this is usually the first place they look to for financial recovery purposes. Our client looked to the driver’s PIP policy and once that was exhausted, shifted her focus to the driver’s health insurance for money to pay for all of her and her children’s recovery expenses. However, the mental and psychological impact still remains damaged due to witnessing her children being struck by a large vehicle.
